TERMS AND CONDITIONS FOR THE HIRE OF CLIC LA MODE STUDIO
Definitions:
"the Booking Form" means the Studio booking form
"the Client"means any person or organisation dealing with the Studio or any agent, representative, servant, employee or subcontractor of such person or organisation
"the Equipment"means all fixtures and fittings and all equipment existing in or provided by the Studio including but not exclusive to lighting, polyboards stands and coloramas
"the Studio"means Clic La Mode Studio, Studio 24 Unit 0, Second Floor Studios, Mellish Industrial Estate, Warspite Road, London SE18 5NR
"us/we/our"means the Studio
Hire Fees:
The basic day rate for photographic stills shoots is £250 for a standard day or as agreed with the studio manager prior to the hire. A basic Studio day is from 0900 hours to 1700 hours. (1000-1800 available upon request) Use outside these hours shall be subject to our agreement and the Client will be charged at an additional hourly rate of £40.00
Discounted Rates: Editorial Work
The discounted editorial rates are a reduction on the standard day rate. This rate is not available for paid commercial work or advertising work of any nature. Any Client found to be in breach of this will be billed in full at the non discounted day rate and will not be eligible for any further part of the discount scheme. Determination of jobs are at the discretion of the Studio management only.
Discounted Rates: Personal Work
The discounted personal work rates are a reduction on the standard day rate. This rate is not available for paid editorial work, commercial work or any work of any nature which involves the photography having been commissioned by an additional client. Any Client found to be in breach of this will be billed in full at the non discounted day rate and will not be eligible for any further part of the discount scheme. Determination of jobs are at the discretion of the Studio management only.
Discounted Rates:
Any discount from the full day rate is only applicable if paid within the agreed payment terms of the invoice. If the invoice is paid late then the invoice will be resissued at full day rates and overtime rates which will be due immediately.
Booking and Cancellations:
A £50 deposit is required to secure any booking. This is a non-transferable and non-refundable deposit and is only applicable for the day of requested booking. Studio bookings are not confirmed until receipt of the £50 deposit and a completed booking form. The Client's date will not be held until this payment is received and cleared. If the Studio must cancel Client's reservation, the Client will receive a full refund. The deposit payment and booking form for Client's rental must be received before Client's reserved time begins. The Studio reserves the right to refuse reservations at its sole discretion.
Payment Terms:
For first time bookings The Studio's standard payment terms are 14 days from the date of booking. In certain circumstances or for pre-approved commercial Clients accounts are available for bookings. Accounts are then invoiced and are payable within 30 days of the date of our invoice. Overdue accounts will be billed at the full studio amount and accrue interest at 4% per month or part thereof.
Provisional Bookings/Studio Options:
Clients may make provisional bookings of the Studio. The Client will be given the chance to confirm their provisional booking but in the event that the Client is unable to confirm, please note that any party who is able to confirm a provisional booking made subsequently, will take priority. It is therefore in the Clients interests to confirm a provisional booking with deposit as soon as possible.
Equipment:
The Studio agrees to provide equipment in good working order, but makes no special guarantees as to said equipment's functionality or suitability to the Client's purposes. Any Equipment lost, damaged or stolen will be charged to the Client at its full replacement cost. The Client may not remove any Equipment from the Studio premises and all Equipment must be returned promptly at the end of the hire period and in good condition. If the Client has any special requirements for equipment or lighting, please let us know of such requirements and we will use our reasonable endeavours to make provision for these and inform the Client of any additional charges.
Client Materials:
Unless otherwise agreed with us, materials used in connection with sets and props constructed by the Client and all other equipment are to be collected and removed from the Studio premises at the end of the hire period and at the expense of the Client. If they are not collected by this time, we reserve the right to dispose and recharge any costs associated with so doing. A storage charge may be incurred for each day the Client materials remain.
Studio Premises:
The Client shall be responsible for all or any costs or expenses incurred by us as a result of any damage by the Client to the fabric or contents (including furniture) of the Studio premises. No alterations decorations or additions to the Studio are permitted without our prior consent. In any event at the end of the hire period, the Studio must be surrendered in the same condition that it was in at the start of the hire period.
Length of Use:
Full day rental periods are 8 hours. Studio clean up must be completed by the end of the rental period. If the studio is not satisfactorily returned to the state it was prior to the rental period, the Client will be charged a clean-up fee of one hours full rate overtime (£40). Do not arrive late – the Client's rental time begins promptly at the designated starting time and ends promptly at the designated ending time. There will be NO exceptions to this.
Terms of Use:
Use of the Studio and equipment is at the CLIENT'S OWN RISK. The Client hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on our premises. The Client agrees to leave the studio and adjacent grounds in the same condition as when the Client arrived. The Client is solely responsible for any legal infractions they or members of their party make during the conduct of the shoot, be they in our studio or elsewhere. The Client agrees to be solely responsible for the conduct and welfare of all persons accompanying the Client whilst on our premises. The Client is solely responsible for the safety and well-being of any models they engage. The Client understands that if the Studio observes that dangerous or negligent practices or activities are being engaged in the Studio reserves the right to stop the shoot and require the Client and the Client's party to leave immediately. However, the Studio assumes NO RESPONSIBILITY to act in such cases. The Client agrees to hold Clic La Mode Studios, its agents, representatives, and anyone acting on behalf of the Studio completely harmless from any action, legal or otherwise, that results from the Client's conduct.
Save in respect of anything which cannot be excluded by Statute, neither the Manager nor the Studio takes responsibility for any loss or damages suffered by the Client, caused by, or arising from its use of the Studio or any Equipment. All equipment and valuables brought on to the Studio premises by the Client shall be at the Client's own risk. It is in the Client's best interests to make sure that they have sufficient insurance to cover themselves and their equipment.
The Client agrees to hold harmless the Studio, its owner, agents, representatives, and contractors acting on its behalf for any loss, accident, or injury to The Client's self or anyone who accompanies The Client whilst on our premises.
The Clic La Mode Studio is part of the Second Floor Studios Enterprise and users of the studio must abide by Second Floor Studios' rules when on their property.
In accordance with this are the following clauses:
Public Areas:
Use of the public common areas is permitted but priority lies with the resident artists. This includes the use of the kitchen, toilets, and common sitting area. If used these areas must be left in a clean and tidy manner, in the same condition as when the Client arrived
Noise Levels:
Noise levels must not raise to levels where they would disturb artists in the neighbouring studios. This applies not only to common areas and corridors but also to the studio itself. Music must NOT be excessively loud.
Fire Regulations: Full name and contact details of all people attending the shoot must be provided by email to the studio manager prior to the shoot day(s) for the visitors fire log. All fire escapes are clearly marked, the use of lifts is not permitted in case of fire. There are fire extinguishers both in the studio and outside the studio door.
Smoking:
There is only one designated smoking area for the entire site which is the raised walkway area by the river wall outside of the building. This is strictly enforced due to certain fire hazards within the site.
These terms and conditions shall be read and construed in accordance with English Law
